Master Terms of Service
The agreement between you and SoulSepAI for using ViserUp. Covers eligibility, accounts, acceptable use, subscriptions, AI outputs, IP, disclaimers, liability caps, and how disputes are handled.
1. About these Terms
These Master Terms of Service ("Terms") form a binding contract between you ("you", "user") and SoulSepAI (ABN 19 200 874 062) trading as ViserUp ("ViserUp", "we", "us", "our"). By creating an account, ticking the acceptance box at sign-up, or otherwise using ViserUp, you agree to these Terms, our Privacy Policy, Acceptable Use Policy, and the disclaimers referenced below, which are incorporated by reference.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) and legally able to enter a binding contract. ViserUp is not directed at children under 16, and we do not knowingly collect data from them (see Children's Privacy Policy).
3. Your account
You are responsible for the accuracy of information you provide, for keeping your credentials confidential, and for all activity under your account. Notify us at soulsep.ai@gmail.com of any suspected unauthorised use. We may suspend or terminate accounts that breach these Terms, our Acceptable Use Policy, or applicable law.
4. The service
ViserUp is an AI-assisted career tool that ingests resumes, produces ATS compatibility signals, tailors resume content, surfaces job matches from third-party sources, and generates career suggestions. Features are provided on an evolving basis; we may add, change, or remove functionality without notice, and beta features are provided "as is".
5. AI outputs & professional advice
ViserUp uses machine-learning models (including third-party large language models) to generate suggestions. Outputs are informational aids only. They are not legal, financial, tax, migration, medical, or specialist career advice, and no lawyer/agent/broker relationship is formed. You are responsible for reviewing, verifying, and adapting AI outputs before relying on them (see AI & Career Advice Disclaimer).
6. Fees & subscriptions
Free tiers may exist alongside paid plans. Paid plans are billed in advance on the cycle shown at checkout. Except where required by law (including the Australian Consumer Law), fees are non-refundable. We may change pricing on 30 days' notice for the next renewal cycle.
7. User content & licence
You retain ownership of resumes, cover letters, notes, and other content you submit ("User Content"). You grant ViserUp a worldwide, non-exclusive, royalty-free licence to host, process, transmit, and create derivative works of User Content solely to operate, secure, and improve the service for you. We do not sell your User Content and we do not use identifiable User Content to train third-party foundation models.
8. Our intellectual property
ViserUp, the SoulSepAI branding, the interface, models, prompts, code, and documentation are owned by SoulSepAI or its licensors and protected by copyright, trade mark, and other laws. Nothing in these Terms transfers those rights to you (see Intellectual Property Policy).
9. Acceptable use
You must not misuse ViserUp. See our Acceptable Use Policy for the full list. In short: no unlawful, harmful, deceptive, discriminatory, scraping, reverse-engineering, or high-volume automated activity, and no submitting content you don't have rights to.
10. Third-party services
ViserUp links to and pulls data from third-party services (for example, job boards, authentication providers, and AI model vendors). Their terms and privacy practices apply to your use of those services. We are not responsible for third-party content or availability.
11. Disclaimers
To the maximum extent permitted by law, ViserUp is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of AI outputs, or that job matches will lead to interviews or offers. Nothing in these Terms excludes rights that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law.
12. Limitation of liability
To the maximum extent permitted by law, SoulSepAI's aggregate liability arising out of or connected with ViserUp (whether in contract, tort, statute, or otherwise) is limited to the greater of (a) AUD $100, or (b) the fees you paid to us in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, special, exemplary, or punitive damages, lost profits, lost opportunities, lost job offers, or loss of data.
13. Indemnity
You will indemnify SoulSepAI against reasonable losses arising from (a) your breach of these Terms, (b) your User Content, or (c) your misuse of ViserUp, except to the extent caused by our negligence or wilful misconduct.
14. Termination
You may close your account at any time from the Account page. We may suspend or terminate your access for breach, legal risk, or prolonged inactivity. Sections that by their nature should survive termination (IP, disclaimers, liability, indemnity, governing law) will survive.
15. Changes to the Terms
We may update these Terms. Material changes will be notified by email or in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
16. Governing law & jurisdiction
These Terms are governed by the laws of Victoria, Australia, without regard to conflict of laws principles. You and SoulSepAI submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia courts sitting in Melbourne, subject to any mandatory consumer forum rights you may have.
